SOUTH BEND – Superior Court included cases of burglary, dangerous firearm possession, assaults, unlawful narcotics use, and the much abused meth cases.
Marshall Disney is charged with first degree burglary, unlawful possession of a firearm in the second degree and theft of a firearm. Disney entered a plea of not guilty and the matter is set for trial on February 11. According to McClain, officers responded to a theft report. The victim thought that Mr. Disney had taken the firearm and other property because Mr. Disney’s jacket that had been at the residence was no longer there. South Bend Police Chief Dave Eastham went to a home thought to be where Mr. Disney was staying and found Mr. Disney. Mr. Disney was wearing a hat, which had been taken from the home. With the homeowner’s permission, Chief Eastham searched and located the stolen firearm."
Cassandra Renee Garcia, 28, of Raymond entered a guilty plea to two counts of delivery of heroin and one count of delivery of methamphetamine. "Ms. Garcia has a significant criminal history and the State recommended 108 months (120 months was the maximum sentence)." McClain noted. "As part of the plea agreement, the defendant was permitted to request a seven year prison sentence and we were to argue a nine year prison sentence. And, we were pleased that Judge (Mike) Sullivan agreed that Ms. Garcia’s criminal history warranted a significant prison sentence. Garcia has an offender score, which, according to Judge Sullivan, "was off the Richter scale." Meaning that it was greater than the top end of the scale of 9 prior felony convictions — the Sentence Reform Act factors in the number of prior felony points up to nine.
Matthew M. Pearson has entered into the Drug Court program for his possession of methamphetamine.
Mike Jones is charged with possession of one a controlled substance. His bail is set at $50 grand.
Marco R. Medina had requested from prison that his sentence be reviewed, specifically, that he had been sentenced incorrectly to several school bus stop sentence enhancements, which were in addition to his several delivery of methamphetamine counts.
Rex Wayne Crump, 25, was arraigned for assault in the third degree and resisting arrest from Sheriff’s deputies. Crump’s bail was set at $10 grand.
Kevin Gorham, 32, was arraigned on two warrants for failure to comply. His bail was set at $50,550.
Kenny S. McMahan had a motion heard to amend information.
"Mr. McMahan was charged with second degree unlawful possession of a firearm," McClain said. However, because of an early conviction, the case should have been charged as first degree unlawful possession of a firearm and the Court granted the State’s request to amend the sentence.
Teagan S. Hazen, 32, of Long Beach, entered a guilty plea to an amended charge of violation of a no contact order. According to McClain, Hazen was ordered to serve 14 days in jail. "Ms. Hazen’s former boyfriend had been granted a domestic violence no contact order and the two of them reconciled, if only for a brief time, but the order had never been removed," McClain said. "Following an altercation law enforcement officers were called to Ms. Hazen’s residence and arrested Ms. Hazen for a felony assault (assaulting another while there was a valid no contact order in place). Ms. Hazen asserted that the assault was in self-defense.
"After speaking with the alleged victim, it was evidence that Ms. Hazen was defending herself at the time of the assault and I agreed to reduce the charge from a felony to a gross misdemeanor for violating the no contact order in the first place," McClain added. "Ms. Hazen will be on probation for two years and will also have to address other probation matters involving assaultive conduct in Long Beach Municipal Court."
The pretrial case of Brandon R. Makinson remains set for trial. The case involves possession of methamphetamine, which was located on the defendant’s person following an arrest, according to McClain.
Lisa Marie Neaman’s case was set for trial. This case involves the report from a family member to law enforcement regarding narcotics, which were located in a family member’s room.
A warrant was issued for Kenny Sinclair.
Some other arrested by local law enforcement included:
Guadalupe Carrazco, 30, was arrested for 2 counts of possession of a dangerous weapon, possession of a controlled substance (felony) and an outstanding warrant for failure to comply. Carrazco was arrested by the RPD.
Jose E. Meza, 27, was arrested by the SBPD for making a false statement to a public servant and driving with a suspended license in the third degree.
Robert Calvin Olson, 27, was arrested by Sheriff’s deputies for possession of methamphetamine.
Geoffrey A. Clarine, 36, was arrested by Sheriff’s deputies for possession of methamphetamine. His bail was set at $10 grand.
Chad J. Boone, 30, was arrested by the RPD for DUI.
Tara Kristin Stark, 39, was arrested by Sheriff’s deputies for 2 counts of DUI.
Dan W. Greenfield, 25, was arrested for DUI.
